Fulton County Superior Court Rules in Favor of Election Board Member Julie Adams

Atlanta, GA – Citizens Defending Freedom (CDF) is pleased to report that in a landmark decision, Fulton County Superior Court Judge Robert McBurney has ruled that Fulton County Board of Registration and Elections (FCBRE) member Julie Adams must be granted complete access to election procedures and materials. This ruling, delivered on October 14, 2024, marks a significant victory for transparency and accountability in election administration.

 

The lawsuit, filed on May 22, 2024 (Case # 24CV011584), challenged the denial of access to election materials necessary for Ms. Adams to properly certify the county's primary elections held on May 21, 2024.



Ms. Adams stated, "Judge McBurney has affirmed that I, as a board member, have a statutory duty to 'cross-check' the election returns, procedures, etc. This ruling ensures that board members in Georgia cannot be barred from access to the elections in their counties." Additionally, this ruling states that access to election materials is mandatory for board members, not optional, and superintendents must investigate any discrepancies found during the verification process.

 

The America First Policy Institute's Center for Litigation, representing Ms. Adams, commented: "This order preserves her rights to access all necessary election material and to challenge irregularities in election results."

 

This ruling is expected to have far-reaching implications for election administration in Georgia, potentially setting a precedent for increased transparency and thorough verification processes in future elections.

 

Holly Kesler, Georgia State Director for CDF stated, “As a non-partisan organization with a focus on election integrity, we appreciate this ruling as it will increase the integrity of our electoral process. This ruling ensures our Election Board members have the appropriate materials to conduct a proper canvass, prevent and identify fraud, deceit, and abuse, so they may fulfill the ministerial duty of certification.” Kesler added, “This decision is a win for all Georgians.”
