Supreme Court Backs Tennessee Law Protecting Children from Harmful Gender Treatments

WASHINGTON, D.C. — In a major victory for parental rights and common-sense protections for children, the U.S. Supreme Court has ruled in favor of Tennessee’s law that stops doctors from giving puberty blockers and cross-sex hormones to kids under 18 for gender transition purposes.


The case, United States v. Skrmetti, challenged Tennessee’s Senate Bill 1 (SB1), which was designed to protect minors from irreversible and risky medical procedures while they are still developing physically and emotionally. Today’s decision from the Supreme Court upholds that law and affirms what Citizens Defending Freedom (CDF) has been saying all along: states have the right—and the responsibility—to protect children from unproven and potentially harmful treatments.


Chief Justice John Roberts, writing for the majority, said this law doesn’t violate the Constitution because it treats all children the same. It doesn’t ban treatments altogether—it simply says that using these powerful drugs for gender transitions in minors is too risky and should be handled with caution. The Court made it clear: these are decisions for state legislatures and voters to make, not federal judges.


This is a huge win for the people of Tennessee—and for the more than a dozen other states with similar laws. CDF is proud to have filed an amicus brief in this case, and we are encouraged to see the Court echo many of the same arguments we presented.



Justice Clarence Thomas, in a powerful concurring opinion, reminded the nation that these drugs come with serious risks—infertility, bone loss, and other long-term harms. Tennessee’s law puts children’s safety first, and the Supreme Court agreed that this is a valid and necessary concern.
