WHAT YOU NEED TO KNOW:
On April 19, 2024, the Biden administration usurped the United States Congress by expanding the plain meaning of “on the basis of sex” discrimination to implicate sexual orientation and gender identity. A final version of this rule was published in the Federal Register on April 29, 2024 and may be viewed here. As this rule is slated to go into effect August 1, 2024, Citizens Defending Freedom continues to push back against the abuse of the separation of powers and federal law, we encourage you to consult the Title IX Toolkit to stay up-to-date with what CDF is doing to restore the constitutional norms based on the separation of powers and principles of federalism enshrined in our constitutional republic.
WHAT WILL HAPPEN:

Forces every K-12 institution, as well as college and universities, receiving federal funds to admit biological males identifying as females to women’s sporting events or else face boundless civil rights lawsuits.

Allows a student’s chosen gender identity to replace his or her biological sex when deciding which bathroom/pronouns he or she uses, or which athletic team he or she participates in.

Subjects educators and institutions that refuse to comply with the unlawful change to investigations by the Department of Education.

Erodes student privacy by permitting biological males to undress in otherwise sex-separated, intimate facilities reserved for biological females.

Systemically disadvantages female students in schools now forced to compete against biological males identifying as women in sports competitions.

Note: Per a report in the Washington Post, one day after CDF met with the OMB in March 2024, the Biden Administration has postponed review of the transgender athletics rule until after the 2024 election. However, because the newest Title IX changes apply to any institutions receiving federal funding, athletic departments are implicated in this automatically.
